随着我国经济的发展及城市化进程的加快,土地征收和房屋拆迁在经济建设中的使用越来越频繁.尤其是城市房屋强制拆迁是城市建设不可避免的一个问题,这不仅关系到拆迁人、被拆迁人的利益,还关系到城市的发展和社会的稳定.由于城市房屋强制拆迁即涉及到公法,又涉及到私法领域,同时它又具有鲜明的公权力色彩.如今,公权力的过多介入,是城市房屋行政强制拆迁存在大量问题和社会矛盾不断的根源所在.本文从城市房屋拆迁的产生与发展入手,通过研究我国城市房屋拆迁的现状,深入剖析我国城市房屋行政强制拆迁存在的问题,从而提出在现行的法制背景下,如何完善行政强制拆迁制度,以期我国的城市房屋强制拆迁不断规范,减少由于强制拆迁而引发的社会矛盾.维护广大人民群众的根本利益,努力建设社会主义和谐社会.
